Welcome to the website of AF SA Group (Pty) Ltd (Registration No. 2025/936004/07), trading as Anytime Fitness South Africa (“Anytime Fitness”, “we”, “us”, or “our”).
These Terms and Conditions govern your access to and use of the website located at www.anytimefitness.co.za (the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.
These Terms apply only to the Site and do not replace or amend the terms of any membership or other agreement you may have with Anytime Fitness, unless expressly stated.
2. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Nothing in these Terms limits or excludes any rights you may have under mandatory South African law, including the Consumer Protection Act 68 of 2008 (“CPA”) and the Protection of Personal Information Act 4 of 2013 (“POPIA”).
3. Use of the Site
You may use the Site for lawful, personal, and non-commercial purposes only.
We reserve the right to suspend, restrict, or terminate your access to the Site if you breach these Terms or misuse the Site, subject to applicable law.

10. Free Trial Offers
Free trial offers (including “Try Us for Free” or “3-Day Free Trial”) are available at participating clubs only and are subject to:
- Availability and club-specific conditions
- First-time local residents or workers aged 18+
- Completion of pre-exercise screening
- Staffed-hour access unless otherwise stated
Free trials have no cash value, are non-transferable, and may not be combined with other offers. Additional conditions may apply. Please contact the relevant club for details.
11. Third-Party Links
The Site may contain links to third-party websites. We are not responsible for the content, policies, or practices of those websites. Use of third-party sites is at your own risk.
12. Disclaimer of Warranties
The Site is provided on an “as is” and “as available” basis.
To the extent permitted by law, we make no warranties regarding the availability, accuracy, or reliability of the Site. Nothing in these Terms excludes any warranty or right that cannot be excluded under the CPA.
13. Limitation of Liability
To the maximum extent permitted by law:

Nothing in these Terms limits liability for:

ANNEXURE A
United States Parent Company & Cross-Border Provisions
This Annexure forms part of the Website Terms and Conditions and must be read together with them.
1. United States Parent Company
The website and related digital platforms are part of the global Anytime Fitness brand, which is owned and operated internationally through entities affiliated with Self Esteem Brands, LLC, a company incorporated in the United States of America (“US Parent Company”).
While the Site is operated in South Africa by AF SA Group (Pty) Ltd, certain services, systems, technology, intellectual property, and data infrastructure are owned, licensed, managed, or supported by the US Parent Company or its affiliates.
2. Intellectual Property Ownership
All global intellectual property rights associated with the Anytime Fitness brand, including trademarks, logos, software platforms, website architecture, and proprietary systems, are owned by or licensed to the US Parent Company and its affiliates.
Nothing in these Terms or this Annexure transfers ownership of any intellectual property to users or creates any licence beyond the limited right to use the Site in accordance with the Terms.
3. Cross-Border Data Processing
By using the Site, you acknowledge and agree that personal information may be transferred to, processed, or stored in jurisdictions outside South Africa, including the United States, for purposes such as:
- Website hosting and maintenance
- Customer relationship management
- Analytics and security monitoring
- Brand and franchise operations
Such cross-border processing is carried out with appropriate safeguards in place, in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA) and applicable data protection laws.
4. Applicable Law – Mandatory Local Protections
While the Anytime Fitness brand operates globally and certain systems and policies are governed by United States law:
- Mandatory South African laws, including the Consumer Protection Act 68 of 2008 and POPIA, apply to users located in South Africa
- Nothing in this Annexure limits or excludes any non-waivable rights afforded to South African consumers under applicable law
5. Limitation of Liability – US Parent Company
To the maximum extent permitted by applicable law:
- The US Parent Company and its affiliates shall not be liable for indirect, incidental, special, or consequential damages arising from use of the Site
- Any liability of the US Parent Company relating to South African users shall be subject to the limitations and protections set out in the main Terms, read together with applicable South African law
6. No Third-Party Rights
Except as expressly stated, nothing in these Terms or this Annexure creates any rights enforceable by third parties under any applicable law.
7. Precedence
In the event of a conflict between this Annexure and the main body of the Terms and Conditions:
- The provisions of the main Terms shall prevail to the extent required by South African law
- Otherwise, this Annexure shall apply to matters relating to global ownership, systems, and cross-border operations
